Fair Labor Standards Act

Fairfax County Public Schools complies with the federal Fair Labor Standards Act (FLSA).  All nonexempt employees (US-19 and below, instructional assistants, and hourly employees) are entitled to overtime pay for all hours over 40 in a workweek. 

The workweek for School Board employees, with the exception of uniformed school security officers assigned to 12-hour shifts, shall begin at 12:01 a.m. on Saturday and end at midnight the following Friday. The workweek for school security officers shall be defined by the Office of Salary Services in consultation with the Office of Safety and Security, which shall notify the affected officers.

Employees should check with their principal or program manager regarding overtime policies. Most locations require that you receive approval from your supervisor prior to working beyond your regularly scheduled hours.

Nonexempt employees may not volunteer to perform other work for FCPS. The only exceptions are (1) they are the parent of a student working on behalf of their child’s class or school or (2) if the duties being performed as a volunteer are very different from what the employee has been hired to do in their primary position with FCPS.

A principal or program manager may adjust an individual's work hours within a workweek to avoid the payment of overtime.

Individuals who violate school or office regulations regarding FLSA may be subject to disciplinary action.
